Adult Girl Has a Right to Live Life of Her Choice, Says Supreme Court

At the Time when women from all over the country are fighting unfair restrictions imposed on them by our patriarchal society, it is good to see the apex court of the country giving us the much-needed support. On Friday, the Supreme Court of India declared that an adult woman had the right to live her life the way she wanted, reported The Times of India.






A bench comprising of Chief Justic Dipak Misra, Justices A M Khanwilkar, and D Y Chandrachud said:
It needs no special emphasis to state that attaining the age of majority in an individual's life has its own significance. S/he is entitled to make her/his choice. The courts cannot, as long as the choice remains, assume the role of parens patriae (legal protector)

The bench also added:

The daughter is entitled to enjoy her freedom as the law permits and the court should not assume the role of super guardian being moved by any kind of sentiment of the mother or egotism of the father. We say so without any reservation.

The declaration came as a result of a case filed by a woman based in Thiruvananthapuram. The woman wanted her husband to send their 19-year-old daughter back from Kuwait so that she could reside with her. Before dismissing her plea, the bench asked the adult teenager her decision and the girl confidently told the court that she wanted to reside with her father. After this, the case was dismissed, although the court asked her father to send the couple's 13-year-old son to Kerala during summer vacations.
